FMCSA Drug & Alcohol Compliance for CDL Employers
If you employ CDL drivers, or you drive under your own authority, you must follow FMCSA’s drug and alcohol rules in 49 CFR Part 382. These rules spell out who is subject to testing, when tests happen, and what happens after a violation. The Safety Pro Group sets up and manages FMCSA compliance programs for Ohio motor carriers and contractors, so every driver is covered and every record is audit-ready.

Who Must Comply With 49 CFR Part 382?
Part 382 applies to employers of drivers who operate commercial motor vehicles that require a CDL. That includes owner-operators, trucking companies, and construction, utility, and service contractors whose drivers hold CDLs for dump trucks, equipment haulers, and other heavy vehicles.
FMCSA Drug & Alcohol Requirements
Written Policy & Driver Education
Every driver must receive a written policy on controlled substances use and alcohol misuse, along with educational materials explaining the rules and consequences.
Required Tests
FMCSA drug and alcohol testing includes pre-employment (a negative result before driving), random, post-accident, reasonable suspicion, return-to-duty, and follow-up testing. For 2026, the minimum random rates are 50% for drugs and 10% for alcohol. See DOT drug and alcohol testing requirements for other agencies.
Supervisor Training
Supervisors who make reasonable suspicion decisions need 60 minutes of training on alcohol and 60 minutes on controlled substances. See DOT reasonable suspicion training.
Recordkeeping & MIS Reporting
Testing records must be kept confidential and separate from the driver qualification files, for periods ranging from one to five years depending on the record. Employers must prepare annual Management Information System (MIS) data and submit it when FMCSA requests it.
The FMCSA Drug & Alcohol Clearinghouse
The Clearinghouse is FMCSA’s database of CDL drug and alcohol program violations. Employers must:
- Run a full query before a new driver performs safety-sensitive functions
- Run a query on every current driver at least once a year
- Report violations, such as positive tests and refusals, within the required timeframes
Since November 18, 2024, drivers in “prohibited” status lose the privilege to operate a commercial motor vehicle on their state license until they complete the return-to-duty process. We help you register, run queries, and stay current.

How Violations Affect Your Safety Score
FMCSA’s Safety Measurement System (SMS) tracks the number, severity, and dates of safety violations by BASIC category, including Controlled Substances/Alcohol. Violations can raise your scores, increase your chances of an investigation, and hurt your standing with shippers and clients.

Do owner-operators need a drug testing program?
Yes. Owner-operators must join a random testing consortium and meet all Part 382 requirements, including Clearinghouse queries.
What counts as a refusal to test?
Failing to show up for a test, leaving the collection site, an adulterated or substituted specimen, and refusing to sign the required forms are all treated as refusals. A refusal has the same consequences as a positive test.
How long do we keep drug and alcohol test records?
Verified positive results, alcohol results of 0.02 or higher, refusals, and SAP records are kept for five years. Negative results are kept for one year. Collection process records are kept for two years, and supervisor training records for as long as the supervisor performs those duties plus two years.
