Under 49 CFR Part 391, every motor carrier, including individual owner-operators, must establish and maintain a driver qualification file for each driver of a commercial motor vehicle. A missing road test or an expired medical certification can put a driver out of service and trigger violations in an audit. The Safety Pro Group builds and manages electronic driver qualification files for Ohio fleets, so your files are always complete and current.

Driver Qualification File Checklist
| Document | Regulation |
|---|---|
| Driver’s employment application | 49 CFR 391.21 |
| Motor vehicle record (MVR) from each state the driver held a license in during the past 3 years, obtained at hire | 49 CFR 391.23(a)(1) |
| Safety performance history from previous DOT-regulated employers (past 3 years) | 49 CFR 391.23(d) |
| Road test certificate, or a CDL or other accepted equivalent | 49 CFR 391.31(e) / 391.33 |
| Medical examiner’s certificate, or for CDL drivers, the MVR showing current medical certification | 49 CFR 391.43 / 391.51(b)(7) |
| Verification that the medical examiner is on the National Registry | 49 CFR 391.23(m) |
| Annual MVR from each state where the driver holds a license | 49 CFR 391.25(a) |
| Note of the annual review of the driver’s record | 49 CFR 391.25(c)(2) |
| Medical variance or skill performance evaluation certificate, if applicable | 49 CFR 391.49 |
Note: The annual list of violations (391.27) is no longer required. FMCSA removed it effective May 9, 2022. Drug and alcohol testing records required by Part 382 are not kept in the DQF. They’re kept separately under the confidentiality rules in 49 CFR 382.401.
DQF Retention Rules
Keep a driver qualification file for as long as the driver works for you, plus three years after they leave. Some documents, such as annual MVRs, annual reviews, and older medical certificates, can be removed three years after they were created.

Medical Certification Changes for CDL Drivers
Medical certification now flows electronically from certified medical examiners to the state licensing agency. For CDL drivers, the motor vehicle record showing current medical certification has become the primary compliance document rather than the paper card. We track medical expiration dates for every driver and flag them before they lapse.
Who Needs a Driver Qualification File?
Driver qualification files are required for drivers of commercial motor vehicles over 10,001 lbs in interstate commerce, not only CDL drivers. Many Ohio contractors in construction, utilities, HVAC, plumbing, and landscaping are covered because of the trucks they use to move crews and equipment. See our full range of DOT compliance services.
How often do I need to update a driver’s file?
At least once a year for the annual MVR and annual review, and whenever a document such as a medical certification expires. Electronic tracking makes sure nothing slips.
Can driver qualification files be electronic?
Yes. FMCSA allows electronic records as long as they’re accurate, complete, and can be produced when requested. Our system gives you 24/7 access.
What happens if a DQF is incomplete during an audit?
Missing documents can lead to violations, fines, and a lower safety rating. In some cases the driver must be removed from service until the file is corrected.
