Since the early 1990’s ,the Federal Motor Carrier Safety Administration (FMCA) has defined drug and alcohol testing rules and regulations for employees who drive commercial trucks and vehicles that require a commercial driver’s license (CDL). The regulations specify who is subject to testing, when they are tested, and in what situations testing may be necessary. The FMCSA maintains a Safety Measurement System (SMS) which tracks the number, severity, and dates of safety violations. Drug and Alcohol Requirements for FMCSA Compliance

Employers of commercial motor vehicle operators and individual owner-operators must comply with 49CFR part 382 (https://www.fmcsa.dot.gov/regulations/title49/part/382) Controlled Substances and Alcohol Use and Testing. The FMCSA regulations require that a written policy on controlled substances use and alcohol misuse in the workplace be provided to every driver.
