FMCSA Compliance
Since the early 1990’s ,the Federal Motor Carrier Safety Administration (FMCA) has defined drug and alcohol testing rules and regulations for employees who drive commercial trucks and vehicles that require a commercial driver’s license (CDL). The regulations specify who is subject to testing, when they are tested, and in what situations testing may be necessary. The FMCSA maintains a Safety Measurement System (SMS) which tracks the number, severity, and dates of safety violations. In order for your company to to maintain FMCSA compliance, our staff can assist with the development of policies and training programs that will meet regulation requirements.
Drug and Alcohol Requirements for FMCSA Compliance
Employers of commercial motor vehicle operators and individual owner-operators must comply with 49CFR part 382 (https://www.fmcsa.dot.gov/regulations/title49/part/382) Controlled Substances and Alcohol Use and Testing. The FMCSA regulations require that a written policy on controlled substances use and alcohol misuse in the workplace be provided to every driver.

- Awareness Training
- Pre-employment, post-accident, random, reasonable suspicion, return-to-duty and follow-up testing
- Record retention
- Reporting to a management information system(MIS)
